These General Terms of Sale (the "Terms") govern all relations between BoostVote (the "Publisher") and any natural or legal person (the "Customer") subscribing to the BoostVote service on the website boostvote.fr. Subscribing to the service implies full and complete acceptance of these Terms.
BoostVote provides an online service that automates voting on game server listing sites (Minecraft, Dofus, World of Warcraft, DayZ). The service consists of providing the Customer with a dedicated bot, running in an isolated container, which casts automated votes on the sites configured by the Customer and collects the associated rewards on the chosen game server.
Using the service requires creating a personal account with at least a valid email address and a password. The Customer guarantees that the information provided is accurate and undertakes to keep it up to date. The Customer is solely responsible for keeping their login credentials confidential.
The service is billed as a monthly subscription at a single price of €9.99 incl. VAT / month. Prices include all taxes and are payable in advance.
Payment is processed by Stripe Payments Europe Ltd, a PCI-DSS certified payment service provider. No bank card data is stored by the Publisher. Accepted payment methods are shown at checkout (Visa, Mastercard and other bank cards).
If a payment fails, access to the service may be suspended until the situation is resolved. The Publisher reserves the right to adjust its prices at any time; the Customer will be informed at least 30 days before any change and may cancel free of charge before the new price takes effect.
The subscription is entered into for an initial term of one month and is tacitly renewed at each monthly due date for the same term, until cancelled by either party under the conditions of article 6.
In accordance with article L.221-28 of the French Consumer Code, a Customer acting as a consumer has 14 days from subscription to exercise their right of withdrawal.
However, the Customer is expressly informed that performance of the service begins immediately after subscription, at their express request. Consequently, the Customer knowingly waives their right of withdrawal for the supply of digital content not provided on a tangible medium whose performance has begun with their prior consent (article L.221-28, 13° of the French Consumer Code).
By subscribing to BoostVote and requesting that the service start immediately, the Customer acknowledges having been informed of this waiver and expressly accepts it.
The Customer may cancel their subscription at any time from their billing area
(/dashboard/billing) without having to give a reason and without any fee or penalty.
Access to the service is maintained until the end of the period already paid; no pro-rata refund is due.
The Publisher reserves the right to suspend or terminate access to the service, without notice or compensation, in the event of:
The Customer undertakes to:
The Customer acknowledges that automating votes may be contrary to the terms of use of some servers or voting sites, and uses the service at their own and sole risk. The Publisher cannot be held liable for any sanctions applied to the Customer by a third party.
The Publisher undertakes to use reasonable means to ensure the availability and quality of the service, without however being bound by an obligation of result. The service is provided "as is" within the limits of the technical constraints described.
The Publisher does not guarantee the absence of interruptions due to maintenance, malfunctions of third-party voting sites, their technical changes or cases of force majeure.
The Publisher's liability, for all causes combined, shall not exceed the amount actually paid by the Customer for the three (3) months of subscription preceding the triggering event. The Publisher cannot be held liable for any indirect damage (loss of data, loss of opportunity, loss of in-game rewards, commercial damage).
The processing of personal data is governed by the privacy policy, which forms an integral part of these Terms.
The Publisher reserves the right to modify these Terms at any time. Customers will be informed by email or via the dashboard at least 30 days before any substantial changes take effect, and may cancel free of charge before that date if they do not accept the new terms.
These Terms are governed by French law. In the event of a dispute, the parties will first seek an amicable solution. Failing that, a Customer acting as a consumer may use a consumer mediator free of charge (article L.612-1 of the French Consumer Code). The competent French courts shall have sole jurisdiction if the amicable resolution fails.
